Client Testimonial

“From the start of the trial: the jury selection, John's opening statement, his courtroom demeanor, his lines of questioning, his exhibits, his demonstrations and his final closing argument; his expertise and professionalism were outstanding. I cannot even begin to explain my feeling and relief when the jury came back with my "not guilty" verdict.”

Measure 11 Criminal Defense Lawyer

Measure 11 crimes in Oregon are the most serious of accusations. If you or somebody you know is charged with a Measure 11 crime in Portland, Multnomah County, Clackamas County, or Washington County, contact an Oregon criminal attorney immediately to determine your best course of legal action.

Measure 11 is the name for the Oregon Statute passed in 1994. It requires judges to pass down manda-tory sentences to defendants convicted of serious crimes throughout Oregon, such as murder, rape and assault. It also denies shortened sentences for good behavior or early parole. If you’re convicted of a Measure 11 crime in Oregon, you’re almost certainly going to be in prison for a lengthy sentence.

The following are the crimes that fall under the mandatory sentencing guidelines in Oregon along with their mandatory prison terms:

  • Murder 25 years
  • 1st degree Manslaughter 10 years
  • 2nd degree Manslaughter 6 years, 3 months
  • 1st degree Assault 7 years, 6 months
  • 2nd degree Assault 5 years, 10 months
  • 1st degree Kidnapping 7 years, 6 months
  • 2nd degree Kidnapping 5 years, 10 months
  • 1st degree Rape 8 years, 4 months
  • 2nd degree Rape 6 years, 3 months 1st degree
  • Sodomy 8 years, 4 months
  • 2nd degree Sodomy 6 years, 3 months
  • 1st degree Unlawful sexual penetration 8 years, 4 months
  • 2nd degree Unlawful sexual penetration 6 years, 3 months
  • 1st degree Sexual abuse 6 years, 3 months
  • 1st degree Robbery 7 years, 6 months
  • 2nd degree Robbery 5 years, 10 months

For 15 years now, the controversial Measure 11 statute has been credited with increasing convicts sent to prison in Oregon. Often times defendants facing these crimes opt to plead guilty to lesser crimes (a plea bargain) in order to avoid stiff penalties required under Measure 11.
